Terms & Conditions for the supply of goods through the Heathorn’s Online Store

Site Access

Access to this site is permitted on a temporary basis. You may only use this site to browse the content, make legitimate purchases and shall not use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent purchases.

You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms and that they comply with them.

The entire contents of this website, including all jewellery designs, photos, logos, copyright trademarks and other intellectual property rights it contains, including the use of the name “Heathorn’s”, is the sole property of Heathorn’s.

You may store, print and display the content supplied solely for your own personal use and you may draw the attention of others within your organization to material posted on our site. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this website, nor may you use any such content in connection with any business or commercial enterprise. By using this service, you agree that you will not attempt to undermine the integrity of this website.

Terms & Conditions

Terms & Conditions shall apply to all contracts, purchases and or transactions entered into with Heathorn’s (hereafter, “we, our or us”).
By placing your order with us, via our website, you (the “client, buyer or purchaser”) agree and accept these Terms & Conditions. Where these Terms & Conditions are not accepted or adhered to, permission to continue on this website may not be granted.

By visiting and or purchasing an item from this website, you engage in our “Service” and agree to the Terms & Conditions including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all
users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. Our online store is hosted by WooCommerce which provides us with the online e-commerce platform that allows us to sell our products and services to you.

Changes and Updates

We aim to update our site regularly as possible and content and pricing may be changed at any time without any prior notice. If the need arises, we may suspend or deny access to our site, or close it indefinitely.

Any item on our website may be out of date or unavailable at any given time and we are under no obligation to update such material.

Contract or purchase order

No contract will exist between you and Heathorn’s for the purchase of any item unless and until Heathorn’s has accepted your order with a confirmation e-mail or full payment is taken from your credit card or full payment via EFT. Our acceptance of your order brings into existence a legally binding contract between the two parties. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts.

Heathorns’s reserves the right to withhold the order in the event that we are unable to obtain authorization for payment if shipping restrictions apply to a particular item, if the item does not meet our quality control standards and is withdrawn, out of stock or if there is an error in pricing or content.

Heathorn’s also reserves the right to deny any transaction for any reason or refuse service at any time, at our sole discretion. We will not be held liable for indirect or consequential loss, damage or expenses arising from not accepting your order and we shall have no liability to you, by way of compensation, other than to refund the amount paid for the goods in question.

Product Availability

Lead time is dependent on stock availability. Should we have stock available, orders will be dispatched the same day provided payment is validated/received before 14:00 hours.

Should the product not be available, it will take approximately 10-20 working days (plus freight transit time) for the sale to be processed. This would be communicated to the customer and therefore be the customers’ choice to continue with the sale.

While every effort is made to effect shipment of your order timeously, however, unforeseen circumstances may cause delays. Should we be faced with such an occurrence, the Heathorn’s WooCommerce team will contact the customer via e-mail and provide a revised shipping schedule.

Payment Methods

Pricing and stock availability are only applicable to online purchases and may differ from pricing and product in our store.

All prices include VAT of 15%.

All transactions will be processed in South African Rand (ZAR).

All credit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment, we will not be liable for any delay or non-delivery.

Payment can be made by credit card or via EFT. All credit card transactions on this site are processed using PayFast, which is a secure online payment gateway which encrypts the buyer’s card details in a secure host environment.

Goods paid via EFT payment, will only be shipped, once a proof of payment has been received and cleared by our bank.

Order Cancellation

Delivery of items can only be cancelled before the item has been shipped from our premises.

You will need to notify Heathorn’s before 14:00 on day of shipment if any cancellation and refund need to be made.

If any cancellations are done after shipment has already commenced, the buyer will be responsible for returning the item, at own cost, to our premises with original invoice and in its original condition.

You will be notified via e-mail as soon as the goods have been shipped from our premises.

Declaration

The customer must inform Heathorn’s of any material which the customer is allergic to. The customer agrees that Heathorn’s cannot be held liable for any harm caused as a result of failing to disclose any allergies prior to ordering or purchasing.

Defective and Damaged Items

If the item does not comply with the requirements of specifications the item must be returned to us in its original condition and packaging.

The buyer is responsible to deliver any damaged goods directly to our premises. If you should receive an item that is defective, damaged or not what you ordered, please contact us within 5 (five) working days. We will help you resolve any issues as quickly as possible by replacing or repairing the item, once the faulty item has been returned to us by post or delivered to our premises.

We will confirm the return address in writing once you have contacted us about the fault. Items will only be considered for repair or replacement once the item has been inspected by us. Returning goods will only be accepted along with proof of payment and any accompanying paperwork and invoice. If the item cannot be repaired or replaced, we will refund you in full.

Changes to Terms & Conditions

You can review the most current version of the Terms & Conditions at any time on this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms & Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

These Terms & Conditions set out the entire agreement between you and in respect of the sale, purchase and use of the goods. They supersede any previous agreement or understanding in relation to the subject matter hereof. No variation of these Terms & Conditions are binding on us unless agreed by us in writing.

Complaints

We are open to receive any legitimate/honest customer complaints from our customers,
subject to the following:

  1. The goods and original TAX invoice must be submitted.
  2. The customer will not claim a refund or remedy and accept full responsibility should the goods be damaged due to misuse, abuse or gross negligence on their part.
  3. The customer accepts, that should the goods have a defect, failure or hazard, he/she will immediately notify Heathorn’s.
  4. The customer accepts that he/she must comply with any safety warnings and instructions provided by the supplier.

Consent

I understand that all the designs and trademarks are registered to Heathorn’s and hereby accept the Terms & Conditions.

I undertake not to copy/duplicate the trademarks and designs directly or indirectly in any way and understand the legal implications thereof.

Should I be found to be in violation of this agreement, I understand that I will be held liable for all legal costs incurred by Heathorn’s for any civil action or any legal action deemed necessary against me.
